Merchandise Auctions

These Terms and Conditions ("Terms") govern your access to and use of the Merchandise Auctions online auction platform. By using this platform you agree to these Terms.

1. Acceptance of Terms

By registering for an account, browsing auctions, or placing bids on this platform, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the platform.

2. Registration & Eligibility

You must be at least 18 years of age to register and bid. You agree to provide accurate, current, and complete information during registration and to keep your account credentials confidential. You are responsible for all activity that occurs under your account.

3. Bidding & Binding Bids

All bids placed on this platform are legally binding offers to purchase. By placing a bid, you are committing to complete the purchase if you are the winning bidder. Bids cannot be retracted or cancelled once placed. The highest bidder at auction close wins the lot.

4. Buyer's Premium & Fees

A buyer's premium may be added to the hammer price of each lot. The applicable buyer's premium percentage will be clearly stated on each auction listing prior to bidding. All applicable taxes are the responsibility of the buyer.

5. Payment

Payment is due within 48 hours of receiving your invoice unless otherwise specified in the auction terms. We accept major credit cards, debit cards, and cash for in-person pickups. Failure to pay within the required timeframe may result in account suspension and forfeiture of the lot.

6. As-Is Sales

All items are sold as-is, where-is unless explicitly stated otherwise in the listing. We make no warranties, express or implied, regarding the condition, merchantability, or fitness for a particular purpose of any item. Buyers are encouraged to review all available photos, descriptions, and condition notes before bidding.

7. Pickup & Removal

Winning bidders are responsible for picking up items within the timeframe specified in the auction. Pickup is at our facility located at 2035 Sigman Rd, Conyers, GA 30012, Monday through Friday, 9:00 AM – 5:00 PM. Items not retrieved within the allowed period may be subject to storage fees or forfeiture without refund.

8. Limitation of Liability

To the maximum extent permitted by law, Merchandise Auctions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or from any transaction conducted through the platform.

9. Prohibited Conduct

You agree not to engage in bid manipulation, shill bidding, fraud, or any other conduct that undermines the integrity of the auction process. Violations may result in immediate account termination and may be reported to appropriate authorities.

10. Modifications

We reserve the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Continued use of the platform after changes are posted constitutes acceptance of the revised terms.

11. Governing Law

These Terms and Conditions are governed by the laws of the State of Georgia, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Rockdale County, Georgia.
